Should Simple Possession of Marijuana still be a Crime?

Has this ever happened to you or someone you know?

It is a beautiful summer day in August, and two young men, ages 23 and 21 are driving  back from an eatery in a sleepy Morris County town. Joe looks in his rear-view mirror and spots a police patrol car with its lights flashing. Joe immediately pulls to the side of a small, winding road and waits.

The police officer “exits his vehicle” and approaches the drivers side window. The officer looks in the car window, and immediately orders both men to step out their vehicle (aka, “car”).

Backup arrives in less than a NY minute, and both young men are handcuffed and thrown to the grown. After a warrant-less search of the vehicle, the police find 2 small, less than one-half inch, burnt roaches in the car.

Possession of 15 grams or less of marijuana

A Bill (A4252) was introduced in the NJ Assembly on November 10, 2011 that would decriminalize the possession of 15 grams or less of marijuana. Violators would be subject to civil penalties, collectable in the Municipal Court where the violation occurred.

The proposed penalties are $150 for a first violation, $200 for a second and $500 for a third or subsequent one. A third-time offender age 18 or older would be referred to a state-sanctioned drug education program, and a minor, to the Family Part.Possession of drug paraphernalia for personal use of 15 grams or less of the drug would carry a $100 civil penalty.
