NO SHIELD FOR BLOGGER, N.J. COURT RULES

The N.J. Law Journal reports:

Most bloggers aren’t journalists, at least when it comes to availing themselves of a New Jersey statute that gives reporters a privilege against revealing their sources, the state Supreme Court says.

Tuesday’s ruling, in the ominously named Too Much Media LLC v. Hale, A-7-10, means that blogger Shellee Hale, of Washington State, can be made to reveal her sources for her allegedly defamatory Internet postings about a Freehold software company. But the Court went further in the widely awaited decision, rejecting arguments by media and civil liberties advocates for a broad reading of the Shield Law and putting most of the blogosphere outside its protection.
